The below provisions constitute the privacy policy (further on: “Privacy Policy”), which defines the terms regarding data collection including personal data of the users who use service(s) provided by SellerSwitch Sp. z o.o. based in Warsaw at Al.. Jana Pawła II 61/10, (further on: “SellerSwitch”) and the ways of data’s processing. To accept the Regulations of the services provided by SellerSwitch is to accept Privacy Policy.

  1. SellerSwitch Sp. z o.o, 01-031 Warszawa, Al. Jana Pawła II 61/10, Company number: VAT: PL 5272774712 is the administrator of your personal data.
  2. The personal data was acquired directly from you or from publically available sources
    (particularly websites related to your professional activities).
  3. The legal foundation of processing the personal data is article 23 section 1 point 5 from Act of 29 August
    1997 about the protection of personal data and since 25 May 2018 it will be Art. 6. section 1(f) of European
    Parliament and the Council of the European Union Regulation 2016/679 since it is processing in “administrator’s
    legitimate interest” – SellerSwitch Sp. z o.o, essential to their performance in compliance with due standards.
  4. The personal data will be processed during your professional activity or until you object.
  5. We inform about the right to review, correct, delete the data, limit its processing, transfer the data, file
    an objection to the processing of data, bring a complaint to the appropriate regulatory organ when the
    processing of data is found to be violating the mandatory provisions of law (Chief Inspector of Personal Data
    Protection, and since 25 May 2018 – Chairman of the Office of Personal Data Protection).
  6. The rights of the person providing personal data that need contacting with the administrator of the personal
    data (SellerSwitch Sp. z o.o) need to be realised via the the e-mail address: kontakt@sellerswitch.com.
  7. SellerSwitch uses cookies which facilitate raising the quality of the services provided by SellerSwitch thanks to storing users’ preferences. Cookies do not identify the personal data of the user, do not have impact on functioning of the end-device or its software. Cookies are a chain of signs, which is sent from SellerSwitch ICT system to user’s computer while running the website by the browser.
  8. SellerSwitch uses two principal kinds of cookies: “session” cookies and “persistent” cookies.
    “Session” cookies are temporary files which are stored in the user’s end-device until the logout, leaving the
    webpage or turning off the software. “Persistent” cookies are stored in the user’s end-device for the period of
    time determined in the parameters of the cookie files or until the deletion by the user.
  9. SellerSwitch uses:
    1. “essential” cookies i.e. enabling the use of the services for example authenticating
      cookies used for services which need authentication.
    2. Cookies used for ensuring safety, for example used for detecting violations in the field
      of authentication within the framework of the services provided.
    3. “Performance cookies” i.e . enabling collection of information on the ways the services
      are used,
    4. “functional” cookies i.e. enabling preservation (“remembering”) of the user’ settings and
      personalised interface,
    5. “advertising” cookies i.e. enabling providing the users with the advertising content which
      is adjusted to their interests and preferences.
  10. SellerSwitch collects the information from cookie files for their own use. They can, however,
    share them with third parties – current and potential commercial partners.
  11. SellerSwitch informs that cookies may originate from third parties, for example entities
    realising advertising campaigns on advertisers’ commission.
  12. The conditions for cookies to work is that they are always accepted by the browser and are not
    removed them from the disk.
  13. In many cases the software used for browsing webpages (browsers) by default allows for storing
    cookies in the user’s end-device.
  14. Besides cookies, SellerSwitch also uses other technologies used for storing data saved during the
    use of the services provided, for example Local Storage technology, which serves for storing the data in a
    separated part of the browser’s memory or other additional modules broadening the functional possibilities of
    the browser (so called plugins). In principle, Local Storage technology is close in its performance and function
    to cookie files, however, in opposition to cookie files storing data in Local Storage has a long-term character,
    i.e. it does not have a default timeout period. Moreover, data stored in the Local Storage is not sent from the
    end-device to the server in an automatic way, like it is in the case of cookie files, but can only be downloaded
    via the webpage, by which they were previously saved.
  15. While using the tools provided by browser available on the market, one can at any time from the
    level of privacy settings, change the settings regarding cookie files as well as other technologies used to
    store data (including Local Storage technology), particularly in such a way as to block their automatic support
    in particular browsers and plugins, alternatively – depending on used technology and tool – inform whenever they
    are placed in user’s end device. Detailed information about the possibilities and ways of handling cookies are
    available in software settings, in particular browsers and plugins. Change of settings might cause some
    difficulties in using the Service or its particular functionalities.
  16. Sellerswitch also enables access to apllications shared by third parties. The data collected by
    SellerSwitch after turning on the application, is processed according to Privacy Policy. The data collected by
    the provider of such and app is covered by the privacy policy of a third party.
  17. Moreover, SellerSwitch might use the collected data:
    1. for developing new functionalities within the framework of the service provided as well as
      its perfecting;
    2. for creating new services;
    3. for protecting the rights of SellerSwitch;
    4. If it is indispensable, for the completion of the legal interests realised by SellerSwitch
      or data’s recipients when the processing does not violate the rights and liberties of the person
      concerned.
  18. SellerSwitch guarantees that the personal data transmitted will not be shared with third parties
    unless:
    1. The obligation of sharing the personal data results from the provisions of laws or when
      the data transmitted serves the objectives of protecting SellerSwitch or deciding a dispute; or:
    2. the user gave his/her consent for transmitting the personal data to third parties.
  19. However, SellerSwitch declares that:
    1. the personal data might be shared with third parties, by the aid of whom SellerSwitch
      performs particular functions appropriate for conducting day-to-day operations, e.g. settling or sending
      prizes in competitions. SellerSwitch exercises the utmost care that the third parties, with whom the
      personal data is disclosed in the objective described above, treat the transmitted data in accordance
      with Privacy Policy and in the way which is compliant with the existing provisions of law;
    2. the data, other than personal data, including cookies, might be shared with third parties
      – current and potential trading partners of SellerSwitch.
    3. personal data and data other than personal data might be shared with third parties in case
      of user’s using an application shared by third parties, about which the user is notified before using a
      particular application. Transferring the data from SellerSwitch ICT system happens in such a case at
      risk and on request of the user.

The safety of the personal data

SellerSwitch uses technical and organisational measures which aim at the best protection of the personal data collected by SellerSwitch against unauthorised access or misuse by unauthorised parties. The technical means applied are being modernised with development of new technologies, new needs as well as available means of protection. The organisational means applied ensure that in SellerSwitch structures only authorised persons have the access to user’s personal data. SellerSwitch regularly controls the correspondence of their activities with the appropriate provisions of law and Privacy Policy. SellerSwitch cooperates with the state institutions responsible for the control of gathering and processing the personal data and each time they implement their prospective recommendations.
